Tax, Customs and GST

Attorney’s at the Firm have extensive experience in tax litigation and tax advisory work. The team has successfully represented various corporates before Courts and Income Tax Appellate Tribunal (ITAT) and Commissioner of Income Tax (Appeals). Further, attorney’s have advised a number of domestic and international companies on tax issues relating to corporate tax, transfer pricing, tax aspects of mergers, acquisitions and restructurings, including advising private equity funds on structuring options, while investing into Indian companies. In addition, members of the Firm have advised on general corporate tax matters, including service tax, goods and service tax, and other aspects of indirect taxation.

The Firm also handles litigation matters at various levels up to Supreme Court on various aspects of tax regulations, including income tax, service tax, goods & service tax and customs duty. The Firm has  also advised clients on various aspects associated with economic laws, regulations and offences,, including advise on matters involving Enforcement Directorate, matters relating to exchange control violations under the Foreign Exchange Regulation Act. In addition, the Firm has also advised clients on  seizers, investigations and prosecution.

Additionally, Archer & Angel renders expert advisory, audit, training and related services in indirect taxation, ranging from Customs (including Authorized Economic Operator (AEO)– Application & Approval, SVB, refunds, imports, warehousing, project importation, exemptions, anti-dumping duty and drawbacks); Excise & Service Tax (including refunds, rebates and Cenvat credits); Goods & Service Tax Advisory; Directorate General of Foreign Trade (DGFT); Special Economic Zones (SEZ); and other allied activities.

Some of our work includes:

  • Advised number of multi-national companies on various tax aspects, including mergers, acquisitions, a sset purchases, business transfers, restructuring , and setting up of new ventures.
  • Successfully represented a number of companies on tax related matters at various forums, including  ITAT, Commissioner of Income Tax (Appeals), High Courts and Supreme Court of India.
  • Advising domestic and international entities on AEO, including preparation, processing, filing and securing of AEO approvals.
  • Advised number of multi-national companies on indirect taxes, special valuation and securing SVB registration.
  • Have advised and assisted a number of clients on Customs refunds; import, export and warehousing regulations; project importation; anti-dumping duty; and duty drawbacks.
  • Represented one of the world’s largest commodity trading companies, in establishment of factory and warehouses in the states of Gujarat and Andhra Pradesh, including tax advisory and structuring, obtaining all approvals for operation of the factory such as environment clearances, factory license and liaising with excise department, Department of Industrial Safety and Health, land officials etc.
  • Advised domestic and international entities on GST, service tax and other indirect taxes related matters, including preparation of responses, filing of appeals and representation before appropriate adjudicating authority, commissioner and The Customs, Excise and Service Tax Appellate Tribunal (CESTAT).
  • Undertook audit on clients to ensure compliance with Government policies and laws, including identification and rectification of any issues.
  • Advised one of the world’s largest pistachio manufacturers on direct taxes, custom regulations, customs tariff and on procedures required for reduction in the customs duty on import of raw pistachio and ancillary products and seasonings, including dealing with senior bureaucrats in the Revenue Services, Ministry of Agriculture and other functionaries in Ministry of Finance and Commerce. 
  • Advised a large multinational involved in the manufacture and distribution of soaps on obtaining registration with the Drugs Controller for all products falling under the Drugs and Cosmetics Act.
  • Acting for one of the world’s leading pharmaceutical company to obtain registration from customs authorities to prevent known counterfeit products from entering India. Advise on both intellectual property and customs regulations and procedures.
  • Represent a logistics company, which has a patented multi-modal intermediate bulk container with various customs issues in India, including liaising with Ministry of Finance on modification of tariffs and customs department on amendment of regulations leading to re-categorization of containers and lower customs duty.
  • Acted as Indian counsel for large and reputed technology multinational with headquarters in USA acquiring another multinational with a large R & D centre in India, as part of a global merger worth US$ 323 million. Also, advised on cleanup of acquired company including issues relating to mis-declaration leading to service tax claims, illegal procurement of products from domestic market without paying excise duty, non-compliance with various STPI regulations, various income tax and transfer pricing violations. Successfully liaised with relevant Government agencies and resolved all issued without resorting to litigation.
  • Advising one of the world’s largest food processing and manufacturing companies on obtaining all necessary approvals and maintaining all regulatory compliances, and liaised with Ministry of Finance and Ministry of Commerce to reduce import tariffs for certain products being imported from the US.
  • Advised a UK based adventure tourism company in setting-up operations in India and also liaised with Ministry of Tourism for classification of company under a special category, which exempts these unique services from service tax.
